1. Agreement to Terms
By accessing or using AppsbayMailer ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Account Registration
- • You must be at least 18 years old to use this Service
- • You must provide accurate and complete registration information
- • You are responsible for maintaining the security of your account credentials
- • You are responsible for all activities that occur under your account
- • You must immediately notify us of any unauthorized use of your account
3. Service Plans and Billing
3.1 Free Plan
Upon registration, you receive immediate access to our Free plan with basic features. No credit card is required for the Free plan.
3.2 Paid Plans
Subscription fees are billed monthly or annually in advance. All fees are non-refundable except as required by law.
4. Acceptable Use Policy
You agree NOT to use the Service to:
- ✕ Send spam or unsolicited emails
- ✕ Violate CAN-SPAM Act
- ✕ Send malicious content or viruses
- ✕ Engage in phishing activities
- ✕ Violate intellectual property rights
- ✕ Send defamatory or illegal content
5. SMTP Connections (BYOSMTP)
- ✓ You are responsible for your own SMTP connections and credentials
- ✓ We encrypt and securely store your SMTP credentials
- ✓ You must have authorization to use the SMTP servers you connect
- ✓ We are not responsible for SMTP server downtime or delivery issues
6. Your Data and Content
6.1 Ownership
You retain all rights to your contact lists, email content, and campaign data. We do not claim ownership of your content.
6.2 License to Use
You grant us a limited license to use, store, and process your content solely to provide the Service.
7. Service Availability
We strive for 99.9% uptime but cannot guarantee uninterrupted service. Maintenance windows may be scheduled with advance notice.
9. Termination
By You
You may cancel your account at any time through your account settings. Cancellation takes effect at the end of your billing period.
By Us
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for non-payment.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPSBAYMAILER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, DATA, OR USE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
